Politician-Lawyers Duty
Solicitors and barristers have duties to “act with independence in the interests of justice“.
When lawyers hold public office, they are expected to uphold the principles of justice, fairness, and the rule of law.
If a politician, who is also a lawyer, issues a false statement or deliberately ignores a violation of the law, thereby betraying the public’s trust, what consequences might they face?
They must act in the public interest and demonstrate a commitment to serving the community.
Additionally, they are often bound by codes of conduct and ethical guidelines specific to their profession.
These codes include:
Solicitors Regulation Authority (SRA) Code of Conduct:
- Integrity: Solicitors are required to act with integrity, including being honest and maintaining high standards of professionalism.
- Confidentiality: Solicitors must protect client confidentiality and not disclose information without proper authorization, subject to legal and regulatory exceptions.
- Independence: Solicitors are expected to act independently and not be influenced by external pressures that may compromise their professional judgment.
- Competence: Solicitors should provide services to clients competently and maintain their professional knowledge and skills.
Bar Standards Board (BSB) Handbook:
- Integrity: Barristers are obligated to act with honesty and integrity, upholding the public interest and the administration of justice.
- Confidentiality: Barristers must maintain client confidentiality and not misuse information obtained during the course of their professional duties.
- Independence: Barristers are required to exercise independent professional judgment and not be influenced by external pressures.
- Competence: Barristers should provide services to clients with skill, care, and diligence, continually developing their professional knowledge and skills.
